What is Product Liability?

What are the elements of a product liability case?

When a plaintiff files a product liability case, there may be a number of different elements to that case. Some of those elements can include:

  • Negligence. If a plaintiff alleges that the defendant was negligent, this can mean that the manufacturer was negligent in in designing or creating the product, which led to the injury
  • Breach of warranty. If a defendant asserts that a product should work a type of way and that that product fails and causes an injury, this can be a reason for a breach of warranty claim.
  • Strict liability. This theory focuses on how the product is dangerous without having to prove that the manufacturer was negligent.
