New York City firefighters are not eligible for workers’ compensation. Therefore, to gain fair compensation, firefighters can choose from two courses of action: a common-law cause of action, and a special statutory cause of action. These rights are explicitly outlined by the General Municipal Law § 205a and General Obligations Law §11-106. To make a 205-a claim, firefighters must do the following:

  1. Identify any statutes which were violated;
  2. Describe how the firefighter was injured; and
  3. Provide facts that prove negligence as the cause of an injury.
