To do so, the injured party must file a written Notice of Claim. This gives notification to the government that a lawsuit is being brought against them. There is a deadline that must be met for this as well. In the state of New York, injured parties only have 90 days from the date of the injury in order to file a Notice of Claim. If the deadline is not met, the injured party may not be able to hold the government entity liable for their suffering.
